Terms and Conditions

• Terms
“Hirer” shall mean Classicbike4rent. “Client” shall mean the physical person or firm renting a vehicle.

• Insurance
The rental price includes compulsory third party insurance with unlimited cover and comprehensive insurance with an “excess” (the portion of any claim to be paid by the client) which shall be equivalent to the client’s deposit. If the client/rider fails to pay attention to such road signs as stop signs, give way signs or red traffic lights, the comprehensive policy shall provide no cover in the event of accident. This shall also apply to accidents resulting from the client/rider’s being under the influence of drugs or alcohol. The vehicles may not be passed on to any third party without the express permission of the hirer. Any violation of this rule shall nullify comprehensive cover. The client shall immediately report damage or accidents to the police and likewise inform the hirer (also in the case of accidents caused by the client but not involving a third party). The client shall be liable for the whole cost of any damage caused by himself. The client shall also bear the full cost of any damage not covered by the comprehensive policy (in addition, as necessary, to the deposit which in this case shall be used as part payment). If the hirer within 24 hours identifies damage not immediately apparent, he may accordingly charge the client for the cost of repair.

• Rental Conditions
Vehicles shall be rented to persons only on the presentation of identity card or passport and of a driving licence valid for riding the vehicle and to firms only on presentation of the designated person’s valid driving licence. All clients/riders must be physically and mentally fit to ride the vehicle.

• Rental duration and return conditions
The rental period shall be from 10 a.m. to 8 p.m. and in the case of longer rentals from 10 a.m. on the first day to 8 p.m. on the last day. There will be an extra charge of €10 per hour for any rental continuing after 8 p.m. Any journeys outside Mallorca may be undertaken only with the written agreement of the hirer. The hirer retains the right to terminate the rental agreement with immediate effect and to re-possess the vehicle, whenever the client violates the agreement or the client’s untrustworthiness becomes clear after the completion of the agreement. The hirer may refuse any application for hire without giving reasons. In case the rental duration exceeds the period paid for the hirer may re-possess the vehicle at the client’s expense. Unless otherwise agreed all vehicles shall be returned to the place from which they were picked up. Motorbikes shall be supplied with full fuel tanks and shall accordingly be returned with full tanks. Should the hirer need to refill the tank, whether or not at the client’s request, the hirer shall impose a flat-rate charge of €25.00. In case the client does not return the vehicle on time, the client shall be liable with no limit for all damages occasioned by this circumstance after the termination of the rental period.

• Specific Obligations on the Client
The motorbikes shall be secured by the supplied locks when parked. The client is responsible for taking all due precautions against theft and vandalism of the vehicle and for placing it in a garage or other secure place overnight.

• Use
The use of the hired vehicle shall be in strict accordance with traffic regulations (Highway Code). Any use of the vehicles off the public road, for example for competitive sport, is strictly forbidden. The client shall be wholly liable in the event of any violation of this clause for all damage to property or persons. The client undertakes to handle the vehicle with care and to ensure the vehicle remains in good condition. The client shall, in keeping with the traffic, road and weather conditions, use the vehicle in accordance with the stipulations of this agreement. In case of breakdown on the open road all stipulations in this agreement as to the security and supervision of the vehicle shall apply. The client shall be responsible for any and all civil or criminal liabilities arising from injury to persons or damage to property caused by him. The client hereby confirms his agreement that the hirer shall assume no liability whatsoever for personal injury or damage to property of any kind whatsoever and arising from any legal grounds whatsoever, whether arising from any deliberate action by the client or gross negligence on his part.

• Unlimited mileage

• Deposit/Excess is 1500€
The client shall pay the deposit/excess in cash or by credit card. Under the rental agreement taxes or fees shall be included in the rental price. Traffic fines or violations shall be the client’s responsibility. The client is requested to inform the hirer of any traffic fines.

• Refunds
In case of accident for which the client is responsible the client has no right either to the replacement of the vehicle or the refund of the rental payment. In case of accident not caused by the client, he shall have the right to an equivalent replacement vehicle for the remaining rental period. The client may claim no other damages.

• Legal Domicile
Classicbike4rent’s venue (legal domicile) is Palma de Mallorca, Spain. The place of contract and venue is the hiring company’s place of business. In case one or more clauses of this agreement are inoperative, this shall not imply that the whole agreement is inoperative. Verbal supplementary agreements shall not be valid. Additional provisions shall be in writing. The client may not set aside the agreement by means of a counterclaim, save in cases of legally established and undisputed claims.

• Reservation
The payment of 20% of the rental price at least 2 weeks before the start of the rental period is required for reservation. In case the client does not take up the reservation the advance payment shall not be refundable. Cancellation of the reservation shall be made in writing. Reservations made verbally or by telephone shall be binding on the client. The hirer shall make the reserved vehicle available within one hour of starting time.

• Data protection
Insofar as personal data are stored by the hirer (for example name, postal or e-mail addresses) this is invariably because they have been voluntarily supplied. As a rule the processing of offers and services can, as far as possible, be done without revealing personal data. The hirer informs clients in this connection that data transmission by internet (e.g. by e-mail) can involve breaches of security. Completely secure data protection against capture by a third party is not possible. The use by a third party of contact data, published in company details, for the transmission of publicity and information material not expressly requested is hereby expressly forbidden. The website administrators expressly reserve the right to take legal action in case of unsolicited transmission of publicity information, for example by means of spam mails.
